Terms of Service

Vigil is not open to the public yet. These terms describe how Vigil works when it is running, and some of what they describe is not released. Nothing is being sold, so nobody is paying for anything set out below. This note comes off at launch.

What is free, and what is not

Every notification is free. Every filter is free. Role pings are free. There is no limit on how many notifications a server gets, and nothing is ever locked behind voting for the bot somewhere.

Paying raises how many sources one server can watch from 3 to 25, and adds custom message templates and more than one destination channel per source.

That is the whole pricing page and it is at the top on purpose.

Who you are agreeing with

Vigil is a project run from the United Kingdom.

Contact: privacy@vigilbot.net, which is the address for anything, not only privacy.

Adding the bot to a Discord server means the person who added it accepts these terms on that server's behalf.

A separate privacy policy covers what Vigil stores and why. The two are meant to be read together.

What Vigil does

It watches YouTube channels and Twitch streamers and posts a message to a channel you pick when there is a new upload or a stream goes live. You set it up with slash commands. There is no website to log into.

What you agree not to do

• Do not use it to spam a channel, or to notify people who never asked to be notified.
• Do not try to break it, flood it, or work around the free limits.
• Do not use it for anything illegal, or for anything that breaks Discord's own terms, YouTube's, or Twitch's.

If a server does any of that, its access can be stopped.

What we do not promise

Reliability is the entire point of this bot and most of the design goes into it. It is still software, and it sits on top of Discord, YouTube, Twitch and a hosting provider, any of which can go down or change how they work with no notice.

So: no uptime guarantee, no service level agreement, and no promise that every notification arrives.

What you get instead is that the bot polls every source it watches on a timer as well as taking pushes, so a broken push gets caught rather than going unnoticed. /status shows what it thinks the state of each subscription is. Check it rather than assuming.

Paying

• Paid plans are sold through Discord Premium Apps. Discord takes the payment, Discord issues the receipt, and Discord handles refunds under its own rules.
• A subscription applies to one Discord server.
• Cancelling is under "Stopping" below, and it matters: removing the bot does not cancel the subscription.
• A lapsed subscription never stops existing notifications. If a server drops back to the free plan, everything it already has set up keeps delivering. What it cannot do is add new sources beyond the free limit of 3. Downgrading is not a punishment.
• The current price is whatever Discord shows you at the point of purchase. That is the only place it is authoritative, so it is not repeated here.
• Prices can change. A change gets announced before it happens, and Discord's billing decides when it takes effect for a subscription that already exists.

Stopping

You can remove the bot from a server at any time and everything it held for that server is deleted.

Removing the bot does not cancel a paid subscription. Discord bills that, and it carries on until you cancel it in Discord, in the same place you bought it. If you are leaving for good, do that first.

Access can be suspended or removed for anything under "What you agree not to do", or if running the service stops being possible.

If Vigil is shut down for good, that gets announced on this page and in the support server before it happens, with enough notice to set up something else. A notification bot that vanishes overnight is the failure this whole project exists to avoid.

Liability

Nothing here limits liability for anything that cannot be limited by law, including death or personal injury caused by negligence, or fraud.

Beyond that, Vigil is not liable for indirect or consequential loss, and is not liable for a missed notification or for anything that follows from one. Where liability can be limited, it is limited to what that server paid for Vigil in the twelve months before the problem, which on the free tier is nothing. If you are a consumer, your statutory rights are not affected.

Changes

If these terms change, the date at the top changes with them. A change that makes the free tier worse gets announced on this page and in the support server before it happens, because the free tier is the whole promise.

If part of this does not hold

If any part of these terms turns out to be unenforceable, the rest of them still stand.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, you keep whatever rights the law where you live gives you, including the right to bring a claim in your own courts.
